Welcome to Liquor Square.

These Terms and Conditions govern your access to and use of the Liquor Square website, mobile application, social media ordering channels, and any other online services.

By accessing, browsing, registering for an account, or placing an order through our Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at [email protected] so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use Service.

1. Communications

By using our Service, you agree to subscribe to newsletters, marketing or promotional materials and other information we may send. However, you may opt out of receiving any, or all, of these communications from us by following the unsubscribe link or by emailing at: [email protected].

2. Eligibility (18+ Strictly Enforced)

Liquor Square sells alcoholic beverages and related products only to individuals who:

• Are at least eighteen (18) years of age;
• Are legally permitted to purchase alcohol under the laws of Kenya;
• Provide accurate personal information during registration and ordering.

3. Customer Accounts

Customers may create an account to enjoy a faster and more personalized shopping experience. You agree to:

• Provide complete and accurate information.
• Maintain the confidentiality of your login credentials.
• Accept responsibility for all activities conducted under your account.
• Notify Liquor Square immediately if you suspect unauthorized use of your account.
• You guarantee that you are above the age of 18.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.

Liquor Square reserves the right to suspend or terminate accounts that provide false information or engage in fraudulent or unlawful activity.

4. Product Availability

All products displayed on the Platform are subject to availability. Liquor Square reserves the right to limit the quantity of products that may be purchased per customer, per order, or per household where necessary due to stock availability, promotional campaigns, or regulatory requirements. When this occurs, Liquor Square may:

• Contact the customer to offer an alternative product;
• Issue a full refund for unavailable items; or
• Partially fulfil the order where appropriate.

Product images are provided for illustration purposes and may differ slightly from the actual product packaging.

5. Pricing

All prices are displayed in Kenya Shillings (KES) and include applicable taxes unless otherwise stated. Liquor Square reserves the right to:

• Correct pricing errors;
• Change product prices without prior notice;
• Withdraw promotions at any time.

The applicable price shall be the price confirmed at checkout. Delivery charges, service fees, and any other applicable charges will be displayed during checkout before payment is completed.

6. Orders

Submitting an order does not constitute acceptance by Liquor Square. Orders become binding only after:

• Payment has been successfully received (where applicable); and
• Liquor Square confirms acceptance of the order.

We reserve the right to reject or cancel orders due to product unavailability, suspected fraud, failure to verify age, or violation of these Terms.

7. Payment Methods

Liquor Square may accept payment through:

• M-Pesa
• Debit and Credit Cards
• Bank Transfer
• Any additional payment methods introduced from time to time

Orders will only be processed upon successful payment confirmation unless Cash on Delivery has been expressly approved.

8. Delivery, Ownership and Risk

Liquor Square delivers within designated service areas. Delivery times provided are estimates and may vary due to traffic conditions, weather, public holidays, or operational circumstances beyond our control.

Customers must ensure someone aged 18 years or older is available to receive the order. Delivery personnel may request a valid government-issued identification document before handing over alcoholic products. Failure to verify age may result in refusal of delivery.

9. Age Verification ("No ID, No Delivery")

Liquor Square operates a strict "No ID, No Delivery" policy for alcoholic beverages. Acceptable forms of identification include:

• Kenyan National ID
• Passport
• Valid Driving Licence
• Alien ID

Liquor Square reserves the right to refuse delivery if:

• The recipient appears under the legal drinking age;
• Valid identification cannot be produced;
• The recipient appears intoxicated.

10. Returns and Refunds

Returns and refunds shall be governed by Liquor Square's Return and Refund Policy.

11. Customer Responsibilities

Customers agree not to:

• Provide false information;
• Attempt unauthorized access to the Platform;
• Interfere with the operation of the Platform;
• Use the Platform for unlawful purposes;
• Purchase alcohol on behalf of minors;
• Resell alcoholic beverages in violation of applicable laws;
• Misuse products purchased from Liquor Square;
• Engage in fraudulent transactions;
• Attempt to circumvent age verification requirements.

12. Promotions

Promotions, discounts, vouchers, and promotional codes:

• Are subject to specific campaign terms;
• Cannot be exchanged for cash;
• May not be combined unless expressly stated;
• May be withdrawn or modified at Liquor Square's discretion.

13. Intellectual Property

All content on the Platform, including but not limited to: Logos, Images, Product descriptions, Graphics, Videos, Text and Designs; remains the property of Liquor Square or its licensors and may not be copied, reproduced, or distributed without prior written permission.

14. Limitation of Liability

To the fullest extent permitted by Kenyan law, Liquor Square shall not be liable for:

• Indirect or consequential damages;
• Delays caused by third parties;
• Service interruptions beyond our reasonable control;
• Customer misuse of purchased products.

Nothing in these Terms limits rights that cannot legally be excluded under applicable law. To the extent permitted by law, Liquor Square's total liability arising from any claim relating to an order shall not exceed the amount paid by the customer for the affected product(s).

15. Privacy

Your personal information is handled in accordance with the Liquor Square Privacy Policy and applicable data protection laws. By using the Platform, you consent to the collection, processing, and storage of your information for legitimate business purposes.

16. Indemnity

Customers agree to indemnify and hold Liquor Square, its directors, employees, agents, and affiliates harmless from any claims, losses, liabilities, damages, costs, or expenses arising from:

• Breach of these Terms;
• Fraudulent or unlawful conduct;
• Misuse of products purchased from Liquor Square; or
• Violation of applicable laws.

17. Force Majeure

Liquor Square shall not be liable for delays or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including natural disasters, strikes, civil unrest, government restrictions, power outages, internet failures, or other unforeseen events.

18. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Kenya.

Liquor Square will make reasonable efforts to resolve any dispute amicably through discussion and negotiation. Where a dispute cannot be resolved amicably, either party may pursue any remedies available under the laws of Kenya through the appropriate courts or other lawful dispute resolution mechanisms.

19. Amendments

Liquor Square reserves the right to amend these Terms and Conditions at any time. Updated versions will be published on the Platform with the revised effective date. Continued use of the Platform after amendments constitutes acceptance of the revised Terms.
